MICHAEL SUTHERLAND ART TERMS AND CONDITIONS
By purchasing any items from this website or by ordering a commissioned painting, you, the buyer, agree to all the terms detailed below. No permission is given by Michael Sutherland or Michael Sutherland Art in respect of the reproduction of any images or other material on this website or commissioned work. Should you wish to use an image, please contact the artist. All Rights Reserved.
COMMISSIONED PAINTINGS
PAYMENT
Commissions will be accepted with a 25% booking fee (non-refundable after 7 days of booking) to secure a slot in my work diary and waiting list. Once the painting is completed and you have approved the watermarked painting via email or in person, you will need to pay the outstanding balance before the painting is dispatched. You can do this in full or in instalments; however, the artwork will not be delivered until all balances have been fully paid and cleared. Please be aware that I work on a first-come, first-served basis and waiting times can take up to 6 months, so please contact me to ensure your painting can be completed and delivered in the time you need.
7-DAY COOLING-OFF PERIOD MONEY BACK GUARANTEE
You have a 7-day cooling-off period from the date of your booking, in which you may cancel your order and receive your booking fee back in full. After this period, your booking fee becomes non-refundable and will be retained by Michael Sutherland Art to cover administration costs and transaction fees. Once artwork has been completed and approved, no refunds will be issued.
CANCELLATIONS
If the client wishes to cancel after the 7-day cooling-off period, the payment amount will be retained as loss of business to cover the artist's time and resources. If the client wishes to cancel once the portrait has been started, all monies paid will be retained by Michael Sutherland Art.
PRICES
Prices are as per the current published price list on my website. For other commissions, I will quote the client, and this will be the payment required.
COMPLETION TIME SCALE
An anticipated date of completion will be given at the time of booking. While every effort will be made to meet this, it should not be regarded as an absolute guarantee. I typically allow 6 to 8 weeks to complete each commission.
MEDIUM
Commissions are completed using the artist's choice of medium, which may include acrylic, oil, mixed media, or whichever medium(s) suit the commissioned project.
DELIVERY & POSTAGE
Framed, unframed, and mounted artworks will be sent flat packed, with tracking to ensure safe delivery. Most items are shipped within 3-5 business days from completion. If the painting is damaged in transit, please contact Michael Sutherland Art immediately.
COLLECTION
Commissions can be collected by prior arrangement only. Please inform me if you wish to collect your painting.
AMENDMENTS
Suggestions to a painting can be made at no extra charge; however, if these alterations deviate significantly from the original commission, an additional charge may be applied. No amendments will be made once the painting has been approved.
GUARANTEE
If you do not approve the finished painting, you are not required to make any further payment. However, once the finished painting has been approved and shipped, no refunds will be made.
PRINTS (CANVAS AND PAPER)
MADE-TO-ORDER POLICY
All prints, including canvas and paper, are made-to-order, meaning each item is produced only after a customer places an order. Because of this, we do not accept returns or offer refunds for cases where a customer changes their mind or orders the wrong size, colour, or artwork.
DAMAGED OR DEFECTIVE ITEMS
If your order arrives damaged or contains a manufacturing defect, we will offer a free replacement or a full refund. To request a replacement or refund, please contact us at info@michaelsutherlandart.com within 20 days of delivery and include:

A clear photo of the issue

A photo of the barcode label on the packaging

Order ID
Once we’ve reviewed the issue, we’ll arrange a replacement or refund as quickly as possible.
EXCEPTIONS TO RETURNS OR REFUNDS
We cannot offer refunds or replacements if:

The wrong size, colour, or design was ordered

The customer changes their mind after delivery

The print placement or slight variations fall within standard production tolerances
REFUND PROCESS
Refunds will be processed to the original payment method within 30 days of approval. Proof of posting is required for any returns to ensure accountability.
WEBSITE IMAGES
Although every effort is made to ensure that the print images displayed on Michael Sutherland Art’s website are as accurate as possible, I cannot guarantee an exact colour match to the product displayed on your screen due to individual screen and colour differences.
VAT, IMPORT TAX & DUTIES
If a delivery incurs any import tax, VAT, or duties, the customer is solely responsible for these payments. Michael Sutherland Art cannot be held responsible for any additional charges.
COPYRIGHT
Michael Sutherland Art retains copyright on all artwork produced and reserves the right to use paintings and drawings for promotional material and reproduction in various formats.
