MICHAEL SUTHERLAND ART – TERMS & CONDITIONS
By purchasing artwork, prints or commissioned work from Michael Sutherland Art you agree to the following Terms & Conditions.
Nothing in these Terms & Conditions affects your statutory rights. Where consumer protection laws in your country of residence provide additional rights, those rights will continue to apply.
All artwork, photographs, images, text and website content remain the intellectual property of Michael Sutherland Art unless otherwise stated. No artwork or website content may be copied, reproduced or distributed without prior written permission.
1. COMMISSIONED PAINTINGS
Booking & Payment
• A non-refundable 25% booking fee is required to reserve a commission slot.
• The booking fee is fully refundable for seven (7) days from the date of booking.
• After seven days the booking fee becomes non-refundable because studio time has been reserved.
• The remaining balance becomes payable once the finished artwork has been approved via watermarked images or in person.
• Payment by instalments is accepted; however artwork will not be released until payment has cleared in full.
• Waiting times before work commences may be up to six months.
Cooling-off Period
You may cancel within seven (7) days of placing your booking and receive a full refund of your booking fee.
Cancellation
If you cancel after the cooling-off period, the booking fee will be retained to compensate for administration, diary reservation and studio time.
If work has commenced, payments received up to that point will be retained in respect of work completed and materials purchased.
Approval Guarantee
You will receive watermarked images of the completed commission for approval.
If you choose not to approve the artwork, no further payment will be required.
Once approved and paid for, commissions become non-refundable.
Amendments
Reasonable amendments may be requested before final approval. Significant changes to the agreed brief may incur an additional charge. No amendments can be made after approval.
Completion
Estimated completion dates are given in good faith but cannot be guaranteed. Once work begins, commissions are normally completed within 6–8 weeks.
Medium
Michael Sutherland reserves the right to complete commissions using the medium or combination of media most suitable for the artwork.
Delivery & Collection
Completed commissions are shipped using tracked and insured services wherever possible. Damage should be reported immediately with photographs of both the artwork and packaging. Collection from the studio is available by prior arrangement.
2. ORIGINAL PAINTINGS
Original paintings are unique works created by Michael Sutherland. Where stated, a Certificate of Authenticity will be supplied.
Artwork dimensions refer to the painting unless otherwise stated.
Returns
Please review photographs and descriptions carefully before purchasing.
If an original painting arrives damaged or materially differs from its description, please contact Michael Sutherland Art within fourteen (14) days of delivery.
Where applicable consumer law provides cancellation or return rights, those statutory rights remain unaffected.

Delivery, Shipping & Collection
Original paintings are securely packaged and shipped using tracked and insured delivery.
Shipping charges are calculated at checkout and may vary according to destination, size and weight. Certain countries may incur an additional shipping surcharge which will be displayed before checkout.
International customers are responsible for all import VAT, customs duties, local taxes and clearance charges applicable in their destination country.
Ownership transfers once full payment has been received. Responsibility for the artwork transfers upon successful delivery or collection.
If damage occurs, retain all packaging and notify Michael Sutherland Art as soon as reasonably possible with photographs.
Collection from the studio is available by prior arrangement.
3. PRINTS (PAPER & CANVAS)
Made-to-Order Products
All paper and canvas prints are produced individually after an order has been placed.
Where permitted by applicable consumer law, made-to-order prints cannot be returned because of a change of mind, incorrect artwork selection, size or frame choice.
Nothing in these Terms limits your statutory consumer rights.
Damaged or Defective Items
If your order arrives damaged or contains a manufacturing defect, a replacement or full refund will be offered.
Please notify info@michaelsutherlandart.com within twenty (20) days of delivery and provide:
• Order number
• Photographs of the issue
• Photograph of the packaging barcode
Please retain all original packaging until your claim has been resolved.
Refunds
Approved refunds will be processed to the original payment method within thirty (30) days. Where a return is requested, proof of postage should be retained.
Manufacturing Tolerances
Minor colour variation, print placement and framing tolerances are normal manufacturing variations and do not constitute defects.
4. WEBSITE IMAGES
Every effort is made to represent artwork accurately. Colours may vary between monitors, mobile devices and printed artwork.
5. SHIPPING, VAT & IMPORT DUTIES
Customers are responsible for any import VAT, customs duties, brokerage fees or local taxes charged by the destination country. These charges are separate from the purchase price and shipping costs.
6. COPYRIGHT
Copyright in all artwork remains with Michael Sutherland. Purchase of artwork does not transfer copyright. Michael Sutherland Art reserves the right to reproduce artwork for exhibitions, publications, marketing, social media, print editions and promotional purposes.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Michael Sutherland Art's liability shall not exceed the purchase price paid for the artwork.
Nothing in these Terms excludes liability for death, personal injury, fraud or any liability which cannot legally be excluded.
8. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer laws provide otherwise.
